Chattable License and Usage Agreement

1. Overview

Chattable (iframe.chat & our sub-domains) is a free to use service created to provide indie web developers with a customizable live chat experience. This license governs the use, modification, and distribution of Chattable’s source code and associated resources.

2. Permitted Use

• Open Source License: Chattable is provided under an open-source license, meaning you are free to use, modify, and distribute the code provided to you, so long as you adhere to the conditions set forth in this agreement.
• Non-Commercial Use: You may not use Chattable or any derivative works to profit any entity other than the original creator, Andrew / Xobyte. Any commercial use or profit generation from Chattable, whether directly or indirectly, is strictly prohibited without prior written consent from Andrew / Xobyte.
• Personal and Educational Use: You are encouraged to use Chattable for personal projects, educational purposes, and other non-commercial endeavors.

3. Prohibited Actions

• Tampering with Resources: You may not tamper with, modify, or create derivative versions of Chattable that interact with the original Chattable servers or databases in a manner that could disrupt, damage, or negatively impact the operation of Chattable. This includes but is not limited to:
  • Creating or distributing modded versions of Chattable that alter data stored in the original Chattable database.
  • Sending unauthorized requests to Chattable servers that could overload, crash, or otherwise harm the infrastructure.
• Redistribution of Modified Code: If you create a modified version of Chattable, you must clearly indicate that your version is a fork or derivative work and must not imply any affiliation or endorsement by the original creator or Chattable. Redistribution of modified versions that bypass this requirement is prohibited.
• Use of Code for Competing Services: You may not use Chattable’s codebase to create a competing service that offers similar functionality without express permission from the original creator, Andrew / Xobyte.

4. Attribution

Credit to Original Creator: Any public use or distribution of Chattable’s code, whether in original or modified form, must include appropriate attribution to the original creator, Andrew / Xobyte. This includes, but is not limited to, a visible credit in the user interface and a reference to the official project website.

5. User Data Protection

• Data Collection: Chattable only collects data expressly provided by users, such as email addresses, usernames, and other information necessary for the functioning of the service.
• Data Usage: This data is solely used for the purpose of providing and improving the Chattable service. Under no circumstances will this data be shared with or sold to third parties.
• Data Security: Chattable implements reasonable security measures to protect user data from unauthorized access, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and absolute security cannot be guaranteed.

6. Liability Disclaimer

• No Warranty: Chattable is provided "as-is" without any warranty, express or implied. Chattable and its original creator, Andrew / Xobyte, are not liable for any damages arising from the use of Chattable.
• User Responsibility: Users are responsible for any modifications they make and for ensuring that their use of Chattable complies with all applicable laws and regulations.

7. Governing Law

This license and usage agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under this agreement will be brought exclusively in the courts located in Wisconsin, and the parties hereby consent to the personal jurisdiction and venue therein.

8. Termination

Violation of Terms: Any violation of this license and usage agreement will result in the termination of your rights to use, modify, and distribute Chattable. Chattable & Andrew / Xobyte reserve the right to take legal action in the event of a violation.

9. Amendments

Changes to the License: Chattable reserves the right to amend this license and usage agreement at any time. Any changes will be communicated through the official project website or subreddit.
